2. Information We Process
Depending on use of the Service, ATVIXA may process name, email and contact details; business information; account/authentication information; connected marketplace identifiers; authorised API credentials or tokens; product, offer, stock and pricing information; repricing settings; subscription and payment records; support communications; security/audit records; IP address and relevant technical information; and information voluntarily provided through the Service.
3. Purposes
We process information to register and administer accounts; authenticate users; provide requested Services and marketplace connections; perform customer-configured functionality; administer subscriptions and payments; communicate about the Service; provide support; protect security and prevent fraud; maintain appropriate audit records; comply with legal obligations; and establish, exercise or defend legal rights where lawful.
4. Marketplace Credentials
Marketplace credentials or tokens are used only as reasonably necessary for authorised functionality, security and account administration. ATVIXA does not sell marketplace API credentials. Customers should revoke credentials and contact ATVIXA if compromise is suspected.
5. Lawful Processing
ATVIXA processes personal information on an appropriate lawful basis under applicable data-protection law depending on the nature and purpose of processing. Where consent is legally required, appropriate consent will be sought.
6. Operators and Service Providers
ATVIXA may use appropriately selected providers for hosting, infrastructure, databases, email delivery, payments, security, monitoring and technical operations. Providers may process information only as necessary for the relevant service and subject to applicable legal and contractual requirements.
7. Payments
Payments may be processed through EFT, PayFast or other payment services made available by ATVIXA. Third-party processors may process payment information under their own legal obligations and privacy practices. Where card processing is handled by a dedicated processor, ATVIXA does not intend to store full payment-card details itself.
8. Sharing
ATVIXA does not sell customers' personal information. Information may be disclosed where reasonably necessary to provide the Service, to authorised operators, at the customer's instruction, to protect systems or users, to investigate unlawful conduct, or where required or permitted by law.
9. Security
ATVIXA maintains reasonable and appropriate technical and organisational safeguards having regard to the nature of the information and reasonably foreseeable risks. No internet-based service can guarantee absolute security.
10. Retention
Personal information is not retained longer than reasonably necessary for the purpose for which it was processed, subject to lawful record-keeping, security, dispute-resolution and other legitimate requirements. Information may be securely deleted or anonymised when retention is no longer justified.
11. Cross-Border Processing
Some infrastructure or service providers may process information outside South Africa. Cross-border transfers will be addressed in accordance with applicable POPIA requirements.
12. Your Rights
Subject to applicable law, a data subject may request confirmation of whether ATVIXA holds personal information about them, request access or correction, request deletion or destruction where legally applicable, object to certain processing where applicable, and lodge a complaint with the Information Regulator. Requests may be sent to support@atvixa.co.za.
13. Security Compromises
ATVIXA will investigate suspected compromises involving personal information and take notification and remedial steps required by applicable law.
14. Direct Marketing
ATVIXA distinguishes operational communications from direct marketing. Password resets, security alerts, account notices, payment communications and other messages reasonably necessary to administer the Service are operational. Electronic direct marketing will be conducted subject to POPIA and other applicable law. Where prior consent is required for a person who is not an existing customer, ATVIXA will seek that consent in the legally required manner. Where applicable law permits marketing of ATVIXA's own similar services to an existing customer, an appropriate opportunity to object or unsubscribe will be provided. Acceptance of the Terms is not blanket consent to unrelated marketing.
15. Cookies
ATVIXA may use cookies or similar technologies necessary for authentication, security, session management and operation. If non-essential analytics, advertising or other tracking requiring additional disclosure or consent is introduced, relevant controls and notices will be updated.
16. Children
ATVIXA is business software and is not intended for children acting independently as marketplace sellers. ATVIXA does not intentionally solicit children's personal information through ordinary registration.
17. Changes
This Privacy Policy may be updated when processing practices, legislation, security requirements or Services materially change. The current version and effective date will be displayed and material changes communicated where appropriate or required.
